The amount of the deposit, its refund timeline, and permissible deduction scenarios must be specified in the contract
The deposit amount, when it will be returned, and under what circumstances deductions are allowed must all be written into the contract before you sign it. Any deduction reasons not explicitly stated in the contract cannot be used by the landlord to withhold your deposit at the end of the lease.
- Cost
- No monetary cost. It only requires an extra ten minutes when signing the contract. The challenge lies in bringing this up in front of the landlord.
- Benefit
- Regulatory statutes make this clear: “Landlords collecting a deposit must specify the deposit amount, refund timing, and permissible deduction scenarios in the housing lease agreement. Apart from these agreed terms, landlords have no right to deduct funds without valid justification.” In short, three key points must appear in the contract: how much the deposit is, when it’s returned, and under what conditions it can be deducted. Reasons not listed in the contract cannot be used to justify any deductions.
- Note
- On the day of moving out, take photos and videos together with the landlord. Capture readings from water, electricity, and gas meters, as well as images of walls and floors. If your deposit is deducted without cause, first file a complaint with the housing regulatory authority. For smaller amounts, consider pursuing a small claims lawsuit — see Section 8 for details.

When water and electricity are cut off, locks are changed, or you’re threatened to leave — call the police right away: laws forbid using these tactics to force you out
Landlords are strictly prohibited by law from cutting off utilities, changing locks, or threatening tenants to end a lease or force them to move out. If this happens to you, call the police right away. The police report serves as proof if you later seek compensation for any losses. Do not attempt to confront the landlord on your own.
- Cost
- No cost at all. Just make a phone call to the police and they’ll be there immediately.
- Benefit
- Administrative regulations make it clear: “Landlords may not use violence, threats, or any other illegal means to compel tenants to terminate a housing lease or vacate the premises.” Eviction means being forced to move out. In such situations, call the police and preserve all evidence — do not take matters into your own hands.
- Note
- Calling the police ensures you obtain an official report. This report becomes crucial evidence if you later file a claim for damages. Also be sure to notify your local housing authority.

Real estate agents must not collect or remit rent and security deposits; payments go straight to landlords
By regulation, real estate agents are prohibited from collecting or remitting rent and security deposits; all payments must go directly to landlords. Any time money passes through an agent’s hands, it creates one extra chance for them to abscond with the funds. If that happens, you lose both your rent payments and your right to stay in the property. Always confirm that the recipient’s name matches the name on the property title before paying.
- Cost
- No cost at all. It takes just a few minutes to verify the recipient before paying. The hard part is resisting pressure from agents who try to get you to send the money to them instead.
- Benefit
- Administrative rules explicitly forbid real estate agencies from collecting or remitting rent and security deposits on behalf of landlords. This means agents have no legal authority to handle such payments. Every time money moves through an agent’s hands, the risk of them running off with the money rises significantly.
- Note
- Double-check that the recipient’s name matches the name on the property title before making any payment. If it does not, ask for a written authorization first. Agents are only allowed to charge a commission fee for their matchmaking services.

Check a long-term rental’s escrow account before paying a full year’s rent upfront
The discount you get from paying a full year’s rent upfront is minimal. If the rental company goes out of business, you lose both your security deposit and the rent you’ve prepaid for the remaining months. It gets even worse if you take out a rent loan: even if the company disappears, you’re still obligated to make all monthly loan payments. Always check whether the company has a publicly listed escrow account before signing any lease.
- Cost
- No cost at all. It takes just a few minutes to verify.
- Benefit
- Regulations require any housing rental business that sublets units to set up a dedicated escrow account for rental funds and make it visible to the public. Subletting means a company leases entire properties from landlords and then rents them out to individual tenants. The tiny discount from paying a full year’s rent upfront is far outweighed by the risk of losing both your deposit and all prepaid rent if the company shuts down. This risk is even greater if you’ve taken out a rent loan.
- Note
- Carefully check whether any loan products are tied to your lease agreement. If a third-party app lets you pay a full year’s rent upfront to the rental company, and you then repay that amount via monthly installments, you’ll still be responsible for all payments even if the company ceases operations. Avoid signing any such contracts.

House sold during lease term – lease remains valid, no need to move
If a house is sold while you’re still renting it, your lease stays valid. The new owner must honor the original contract and let you live there until it ends. You won’t need to move out or renegotiate any terms. This only applies if you’re already living there legally; be sure to keep proof such as the lease, payment records, and documentation showing when you moved in.
- Cost
- No cost at all
- Benefit
- The Civil Code includes a principle known as “sale does not break lease,” meaning a property sale has no effect on an existing lease agreement. The actual wording is: “Any change in ownership of leased property during the lease term does not affect the validity of the lease contract.” In other words, even if the house changes hands while you’re renting it, the new owner must abide by the original terms and let you stay until the lease ends.
- Note
- This applies only if you’re already residing there lawfully; the law refers to such occupancy as “legal possession and use.” It’s essential to retain all relevant documentation, including the lease, proof of payments, and records indicating your move-in date.

Checking property rights and mortgages before signing the contract; all payments must be transferred with a purpose note
The two most common ways people end up losing all their money are: first, paying rent to someone who isn’t the property owner; second, discovering that the house was already mortgaged to a bank and later seized. Before signing, verify both the property rights and any existing mortgages at the local land registry office. All payments must be made via bank transfer, with a note stating “Monthly rent for [property address]”. This note serves as direct proof in case of any disputes.
- Cost
- No cost involved. The check takes about half an hour.
- Benefit
- These two scenarios represent the typical ways people lose all their money: paying rent to a non-owner, or dealing with a property that’s already mortgaged and seized. Keeping a transfer note that reads “Monthly rent for [property address]” provides solid evidence if a dispute arises later.
- Note
- Property rights information can be obtained from the local land registry office. At the time of signing, the actual owner must be present; if not, a written authorization is required. If you’re renting from a sub-landlord, written consent from the original owner is mandatory.

For second-hand home sales where the agent collects the payment, the funds must be deposited into a dedicated transaction account opened by the agency at a bank
The purchase price can range from hundreds of thousands to millions of dollars — this is the largest single transaction amount discussed in this guide. By regulation, when an agent collects payment, it must be transferred to a dedicated account opened by the agency at a bank, not sent via WeChat to the individual agent. Additionally, when two agencies collaborate on one sale, only one commission fee may be charged; services such as loan processing or title transfer require separate contracts and clear fee agreements beforehand.
- Cost
- No cost involved. The challenge is ensuring the payment goes into the designated account; this may require some discussion with the agent.
- Benefit
- Regulations are explicit: any real estate agency entrusted to collect or disburse transaction funds must use a dedicated client settlement account at a bank. This ensures the payment is held in a regulated account, not the agency’s general account or any individual agent’s personal account.
- Note
- Given the substantial amount involved, never send payment via WeChat to an agent. Two common scenarios involving extra charges also apply: first, when two agencies jointly handle a sale, only one commission fee is allowed; second, services like loan processing or title transfer are separate and must be contracted individually with clear fee disclosures. All payments should be transferred via bank transfer with a purpose note, as outlined in item 6 (verifying property titles and mortgage status prior to signing).

Don’t rent a subdivided apartment: the smallest legal rental unit is the original room as designed; kitchens, bathrooms, balconies must not be used for living.
By regulation, the minimum rental unit is the original room as built. Kitchens, bathrooms, balconies, and basement storage areas cannot be used for living. If such a unit is found to be illegal, you may be forced to move out. Additionally, during the lease term, landlords cannot unilaterally raise rents at will.
- Cost
- There’s no direct expense. The trade-off is that with the same budget, you’ll either have to live farther away or in a smaller space.
- Benefit
- The rules are clear: the smallest legal rental unit is the original room, and it cannot be subdivided into multiple units for separate rentals. The minimum per-person living area must meet local legal standards. Kitchens, bathrooms, balconies, and basements cannot be rented out for occupancy. Landlords also cannot arbitrarily increase rents during a lease term.
- Note
- When illegal room subdivisions are identified, tenants bear the cost of moving out, and often cannot recover their security deposit or prepaid rent. Safety is also a concern: makeshift walls often block emergency exits, and overcrowding in a single unit leads to shared wiring. When viewing a property, check three things: whether any walls were added later, if the room has a window, and whether the electrical meter can handle the expected number of occupants.

Urban residents with hukou who want to live in the countryside can only rent rural houses — they must not buy homestead land or houses on it
People with urban hukou are expressly prohibited by national regulations from buying homestead land, rural houses, or “small-property houses” in villages. Even if villagers claim “a written contract suffices,” paying money does not transfer ownership of the property. To reside long-term in the countryside, one must sign a lease agreement limited to 20 years per term, with renewal possible thereafter.
- Cost
- No upfront cost. The trade-off is that the house remains the landlord’s property; the maximum single lease term is 20 years, after which a new agreement must be negotiated.
- Benefit
- Official documents from the General Office of the State Council make clear: “Urban residents must not purchase homestead land, rural houses, or ‘small-property houses’ in villages.” The same documents also state that after selling or leasing their homes, farmers cannot reapply for homestead land. A 2019 joint directive from the Central Rural Work Leading Group Office and the Ministry of Agriculture and Rural Affairs reiterates this ban while outlining a legal alternative: urban residents may rent rural houses for residence or business use, provided lease terms do not exceed 20 years and are mutually agreed upon upon renewal.
- Note
- Homestead land is allocated solely to registered villagers for construction purposes. When renting a rural house, a written contract must specify the lease term, rent amount, permission for renovations, and how any renovation costs are handled at lease end. Leases exceeding 20 years — such as 50- or 70-year terms — are illegal; likewise, paying rent for multiple years upfront is prohibited. Additionally, it is illegal to use homestead land for building villas, large estates, or private clubs; paying villagers to “co-build” such structures also violates regulations.

When purchasing off-plan presale property, verify the presale permit first; deposit, down payment, and mortgage funds must be deposited exclusively into the designated escrow account specified in the contract
Off-plan presale property refers to residential real estate sold prior to construction completion. Without a valid statutory presale permit, developers are legally barred from selling units or collecting deposits. By regulation, all earnest money, down payments, and bank mortgages must flow directly into an official government-monitored presale escrow account, which cannot be released until the property passes final completion inspection and meets full utility connection standards. Routing funds to any non-escrow account forfeits statutory protection.
- Cost
- Zero financial outlay. Spend a few minutes checking the presale permit and matching the bank account details before wiring funds. The challenge is standing firm when sales agents request payment to alternative auxiliary accounts.
- Benefit
- Under the August 2026 joint directive issued by the Ministry of Housing and Urban-Rural Development (MOHURD), the Ministry of Natural Resources, and the National Financial Regulatory Administration (Jianfanggui [2026] No. 3): "All homebuyer purchasing funds, including down payments and personal residential mortgages, must be deposited in full into the dedicated capital escrow account." Escrow supervision is released only after the residential building completes statutory construction acceptance and meets full operational delivery conditions for water, electricity, gas, and heating. The sales contract must explicitly delineate buyers' rights and developer duties regarding escrow deposits. If the developer defaults or fails to deliver on time, the buyer may rescind the contract and demand a full refund alongside liquidated breach damages. Furthermore, PBOC and NFRA regulations dictate that commercial banks must disburse personal mortgage proceeds directly into the project's designated presale escrow account. Prior regulations (2010 and 2022) established that developers lacking presale permits may not collect deposits via pre-reservations, VIP memberships, or numbering queues; presale contracts signed without a valid presale permit are judged legally void by civil courts unless the permit is cured prior to litigation.
- Note
- For projects that obtained construction planning permits prior to August 28, 2026, local transitional presale supervision rules apply. For completed existing housing where earnest money is paid prior to contract execution, regulations mandate deposit into a dedicated earnest deposit escrow account. The exact account name and number must be verified directly against the standardized sales contract before transferring funds. If a contract is declared void and a developer refuses repayment, civil litigation takes 6+ months with legal fees paid by the plaintiff. Depositing secondary housing funds is covered in Chapter 15, Rule 7. Benefit magnitude is categorized as High based on preventing total loss of housing capital. Primary beneficiaries are yourself and your household.

If a formal contract cannot be finalized or mortgage financing is denied due to reasons not attributable to either party after paying a reservation deposit or down payment, demand a full refund
When you pay a reservation deposit or down payment but a formal sales contract cannot be executed, or mortgage financing fails due to non-fault causes (such as unexpected policy tightening or sudden bank lending moratoriums), the developer is legally obligated to refund your deposit or purchase funds with interest. If loan rejection results from your personal credit defaults or inadequate income documentation, the deposit is forfeited. If rejection stems from developer permitting defects, the developer must return double the earnest money.
- Cost
- Zero monetary cost. Review mortgage contingency and earnest clauses carefully when executing reservation agreements and formal purchase contracts. If a developer refuses a refund, civil litigation is required.
- Benefit
- Under Supreme People's Court judicial interpretations on commodity housing contracts: where earnest money is collected through reservation or subscription agreements and the formal contract cannot be concluded due to fault of one party, standard earnest deposit rules apply (the defaulting depositor forfeits the deposit; the defaulting receiver pays double). However, if the formal sales contract cannot be concluded due to causes not attributable to either party, "the seller shall return the earnest deposit to the buyer." Regarding mortgage financing: where the purchase contract stipulates mortgage financing but the loan contract cannot be finalized, rendering contract performance impossible due to causes not attributable to either party, both parties are entitled to rescind the purchase contract. In such circumstances, the developer must fully refund all received purchase principal alongside accrued interest or refund the earnest deposit. Circumstances not attributable to either party include unexpected macroeconomic mortgage tightening or sudden regulatory credit quotas imposed post-signing. Conversely, failure caused by the buyer's credit delinquency or unverified income represents buyer fault, whereas developer project licensing deficiencies or bank blacklisting represent developer fault.
- Note
- In judicial practice, determining whether financing failure was "not attributable to either party" is evaluated on a case-by-case basis. To safeguard rights, explicitly write financing contingency clauses into the purchase agreement stating what remedies apply if mortgage approval is denied. If a subscription agreement already contains all essential terms of a commodity housing sales contract and the developer has collected housing funds, courts will treat the subscription as a binding sales contract rather than an unexecuted reservation. Pursuing refunds through courts takes 3 to 6 months. Benefit magnitude is categorized as High based on recovering hundreds of thousands in deposits. Primary beneficiaries are yourself and your family.

Clarify floor area discrepancy remedies before signing a new home contract, and preserve photographic evidence of promotional brochures, advertisements, and architectural scale models
Unless the sales contract specifies otherwise, if the registered deed area of a delivered home differs from the contract area by 3% or less, payments are settled on actual area. If the discrepancy exceeds 3%, you are legally entitled to cancel the purchase, and the developer must refund your money with interest within 30 days. Furthermore, specific, concrete promotional promises regarding amenities or specifications within the project development boundary form binding contract terms, even if omitted from the final written contract.
- Cost
- Zero financial outlay. Review the area error terms before signing and photograph marketing scale models, promotional renderings, and sales brochures.
- Benefit
- Under the Measures for the Administration of the Sale of Commodity Housing (Ministry of Construction Order No. 88), purchase contracts pricing property by floor area must specify discrepancy settlement terms. Where contracts contain no alternative provisions, statutory defaults apply: 1) For absolute area discrepancies within 3% (inclusive), payments are settled based on actual delivered area. 2) If area discrepancy exceeds 3%, the buyer has the legal right to rescind the contract. Upon rescission, the developer must refund all payments with accrued bank interest within 30 days of notice. If the buyer retains the property: when delivered area exceeds contract area by over 3%, the buyer pays for the initial 3% discrepancy, while area beyond 3% is conveyed free to the buyer with title transferred; when delivered area is less than contract area by over 3%, the developer refunds the shortfall within 3% and refunds double the shortfall exceeding 3%. Regarding advertising promises, Supreme People's Court judicial interpretations establish that while general sales advertisements constitute invitations to offer, specific and definite descriptions or commitments made by developers regarding housing specifications or community amenities within the project planning scope that have a material impact on purchase decisions are deemed binding contract terms: "Even if such representations and promises are not incorporated into the commodity housing sales contract, they shall constitute terms of the contract," and violations establish actionable breach of contract.
- Note
- The 3% rule serves as the statutory default when the contract does not stipulate otherwise; always examine sales contract templates to ensure developers have not inserted clauses waiving this protection or expanding error tolerances. For units sold on a lump-sum whole-unit basis, contracts must attach architectural layout diagrams specifying dimensional tolerances. The advertising binding rule applies strictly to properties and facilities within the approved zoning and planning boundaries of the development project, and does not extend to external public infrastructure (schools, subway stations, public parks) outside developer property lines. Preserve all original promotional collateral, print brochures, and timestamped photos of the sales hall model. Benefit magnitude is categorized as Moderate based on financial compensation. Primary beneficiaries are yourself and your household.

If a developer delays property delivery or deed registration, serve a formal written notice of demand to preserve evidence, then claim contractual liquidated damages
If a developer delays delivery past the contractual deadline, serve a formal written demand. If delivery remains unfulfilled 3 months after demand, you are legally entitled to rescind the purchase contract. If the contract omits liquidated damages, statutory compensation is calculated based on market rental value for comparable properties in the same neighborhood. If deed registration is delayed past statutory limits by over one year due to developer fault, you may likewise rescind and demand damages. The right of rescission has strict expiration windows, so do not remain passive.
- Cost
- Zero monetary cost. Draft a formal written demand notice, deliver it via registered certified mail with return receipt, and archive delivery tracking. Rescinding the contract or suing for damages requires formal legal proceedings.
- Benefit
- Under Supreme People's Court judicial interpretations: where a developer defaults on property delivery and fails to perform within 3 months following buyer formal demand notice, the buyer is entitled to rescind the contract, unless otherwise agreed. The right of rescission is subject to statutory forfeiture periods: if the developer serves a formal notice demanding the buyer elect remedies, the right must be exercised within 3 months; if no notice is given, it must be exercised within 1 year from the date the right accrued, after which the right is extinguished. Where the contract does not stipulate liquidated damages or loss calculation formulas, delayed delivery compensation is determined by official guidance or certified appraisals of fair market rental value for comparable housing in the same locality during the delay period. Regarding property ownership certificates: the developer is liable for breach if deed registration is uncompleted by contractual deadlines, within 90 days of delivery for off-plan presale property, or within 90 days of contract signing for existing completed property. Where the contract omits liquidated damages, compensation is calculated on total payments received based on benchmark bank overdue loan interest rates. If deed registration remains uncompleted for more than 1 year after the deadline due to developer fault, the buyer is entitled to rescind the contract and claim damages.
- Note
- Always serve demands in writing via tracked postal delivery to the registered corporate address in the contract, archiving physical receipts and signed delivery records. When a purchase contract is rescinded, the corresponding bank mortgage contract can be rescinded concurrently: the developer must refund the mortgage loan balance directly to the bank, and refund all principal payments, down payments, and interest to the homebuyer. Liquidated damages stipulated in contracts are enforceable, though courts may adjust amounts exceeding actual losses by more than 30% upon developer petition. Ordinary civil lawsuits take 6+ months. Benefit magnitude is categorized as Moderate based on preserving legal rescission rights and recovering rental compensation. Primary beneficiaries are yourself and your family.
Conduct title searches for mortgages and court attachments before signing a purchase contract, and file for provisional registration immediately after signing
Before signing a home purchase agreement, visit the local real estate registry with your ID to verify whether the property has existing mortgages, court freezes, or prior registrations. Write provisional advance notice registration into the contract, and file for it immediately upon signing. Once provisional registration is recorded, the seller cannot legally sell, mortgage, or transfer the property to any third party without your written consent. You must complete final title transfer within 90 days of the property becoming eligible for full conveyance.
- Cost
- A few dozen RMB in statutory registration fees. Spend half an hour conducting an in-person title search with government ID before signing, and visit the real estate registry with the seller post-signing.
- Benefit
- Under Civil Code Article 221, parties executing a real estate transaction agreement may apply for advance notice provisional registration to secure future property rights: "After provisional registration is made, any disposition of the real property without the consent of the holder of the provisional registration shall not have effect in real rights." Provisional registration terminates if the underlying contract is rescinded or if an application for final title registration is not submitted within 90 days from the date when registration becomes possible. The Ministry of Natural Resources Implementing Rules for the Interim Regulations on Real Estate Registration apply this mechanism to both new off-plan commodity housing and secondary residential sales: during the validity of provisional registration, registries will refuse any third-party registration filings without the buyer's written consent. In off-plan presales, if a developer fails to co-apply as agreed, the buyer is legally authorized to apply unilaterally. Prior to signing, prospective buyers with transactional intent may query registry databases with their national ID to verify mortgage liens, advance registrations, objection registrations, and judicial seizures. Note that municipal online contract filing is an administrative measure and does not confer real property rights; judicial interpretations confirm that lack of administrative filing does not invalidate contracts unless explicitly made a condition precedent.
- Note
- Verifying property ownership and mortgage status prior to signing is detailed in Chapter 15, Rule 6. Because registry searches without a signed contract may not reveal the registered owner's full legal name, always cross-reference physical deed certificates with the seller's resident identity card in person. Securing provisional registration legally forecloses developer or seller secondary sales and unauthorized secondary mortgaging before deed transfer. While victims of collusive fraudulent double-selling can sue to void fraudulent contracts, litigation is costly and time-consuming; advance registration provides proactive statutory protection. Benefit magnitude is categorized as High based on securing property title. Primary beneficiaries are yourself and your household.

If holding a floating-rate mortgage and prevailing market rates for new mortgages drop significantly lower, negotiate a rate adjustment with your lending bank or apply for a mortgage replacement
Floating mortgage interest rates are calculated by adding or subtracting basis points from a benchmark Loan Prime Rate (LPR). While the spread points were historically fixed for the entire loan life, financial reforms starting in 2024 permit borrowers and banks to renegotiate the spread. When your interest rate significantly exceeds the prevailing rates on newly issued mortgages, you can negotiate a downward adjustment or apply for a new floating-rate mortgage to replace the existing loan. On a 1,000,000 RMB 30-year mortgage, a 0.5% interest rate reduction saves approximately 100,000 RMB ($14,000 USD) in cumulative interest.
- Cost
- Zero direct cost. Submitting an application via bank mobile apps or calling customer service takes several minutes. Banks review eligibility according to regulatory parameters.
- Benefit
- In 2024, People's Bank of China Announcement [2024] No. 11 established a dynamic interest rate pricing mechanism permitting borrowers and lending institutions to renegotiate the basis point spread over LPR for existing residential mortgages. Previously, the contracted spread remained immutable across the multi-decade loan tenure. In August 2026, the PBOC and NFRA codified this mechanism into formal financial directives (Yinfa [2026] No. 171, Art. 24): where the contracted interest rate on existing floating-rate mortgages deviates significantly from prevailing national average rates on newly issued mortgages, "borrowers may negotiate with banking financial institutions to adjust the agreed interest rate level, or apply for a newly issued floating-rate personal housing mortgage to replace existing loans, with the method chosen independently by the borrower." The replacement loan principal cannot exceed the remaining balance of the existing mortgage. Financial modeling example (equal monthly payments over 30 years on 1,000,000 RMB): at a 4.0% APR, the monthly payment is ~4,774 RMB; at 3.5% APR, monthly payment falls to ~4,490 RMB. This yields a monthly savings of ~284 RMB and cumulative interest savings of ~102,000 RMB over the 30-year loan life.
- Note
- The exact deviation threshold triggering repricing negotiations is governed by announcements issued by individual lending banks. This mechanism applies strictly to bank-issued commercial floating-rate mortgages. If a bank rejects rate adjustments and you maintain surplus liquid capital, compare investment returns against the mortgage rate to evaluate early repayment (see Chapter 5, Rule 28). Replacement loans cannot be used to cash out extra debt or exceed remaining principal balances. Benefit magnitude is categorized as High based on substantial multi-year interest savings. Primary beneficiaries are yourself and your family.

When taking out a mortgage on your first home, prioritize the Housing Provident Fund loan and combine it with a commercial loan only for the remainder; never take an entirely commercial mortgage
The interest rate on a first-home Housing Provident Fund loan for terms over 5 years is 2.6%, compared to an average commercial mortgage rate of ~3.1% (as of mid-2026). On a 1,000,000 RMB loan over 30 years, using the provident fund saves approximately 96,000 RMB in total interest over a purely commercial loan. Because provident fund loan caps exist, borrow the maximum provident fund allocation first and cover the remaining balance with commercial lending (a combination loan).
- Cost
- Zero financial fee. Involves making one or two extra trips to the municipal housing provident fund management center or designated trustee bank, and disbursement may take a few days longer than a purely commercial mortgage. Precondition: you must have continuously contributed to the provident fund for statutory minimum intervals.
- Benefit
- On May 7, 2025, the People's Bank of China (PBOC) announced lower interest rates for individual housing provident fund loans effective May 8: the rate for first-home provident fund loans with tenors over 5 years was set at 2.6% (2.1% for terms <=5 years), and second-home loans at not less than 3.075% (>5 years) and 2.525% (<=5 years). As of late 2026, this remains the effective benchmark. Commercial mortgage rates are priced off the Loan Prime Rate (LPR) plus or minus basis points; on September 20, 2026, the 5-year LPR was 3.50%, with the PBOC Q2 2026 Monetary Policy Report recording the nationwide average newly issued personal housing mortgage rate at ~3.1%. Financial simulation using equal monthly principal-and-interest installments illustrates the magnitude: on a 1,000,000 RMB 30-year loan, monthly installments at 2.6% are ~4,003 RMB vs. ~4,270 RMB at 3.1% (saving ~267 RMB monthly and ~96,000 RMB in cumulative interest over 30 years). Even with a combination loan (e.g., 600,000 RMB provident fund + 400,000 RMB commercial), monthly payments decrease by ~160 RMB, saving ~58,000 RMB in 30-year interest. For second homes, the provident fund floor (3.075%) is close to commercial rates (3.1%), yielding minimal difference.
- Note
- Accessing provident fund loans requires meeting four eligibility conditions: (1) contribution duration: national regulations mandate at least 6 consecutive months of full statutory contributions (contributions in other cities can be consolidated); (2) borrowing limits: maximum loan caps are determined by local municipal committees (e.g., Beijing caps single-contributor first homes at 1.2 million RMB, calculated at 200,000 RMB per year of contributions; Guangzhou caps single contributors at 1 million RMB for terms <=30 years, with building age plus loan duration <=50 years); (3) appraisal benchmarks: on existing homes, the loan limit is assessed against the lower of the contract price or government appraisal value; and (4) processing requirements: regulations mandate approval decisions within 10 days of application, followed by mortgage registration. Combined loans must satisfy both provident fund and commercial bank down payment criteria. Accumulated provident fund balances can also be withdrawn for mortgage amortization (see Chapter 5, Rule 3). Renegotiating commercial mortgage interest rate margins is covered in Chapter 15, Rule 15.

If a property management company cuts off water, electricity, heating, or gas to coerce payment of property fees, lodge a complaint with local housing authorities: property managers can only issue notices, sue, or arbitrate for unpaid fees
Property management companies are legally forbidden from cutting off electricity, water, gas, or heating to compel payment of property management fees; if encountered, complain to the local housing administrative bureau. Conversely, if the property company provides contractual services, owners cannot refuse payment on grounds that they "didn't use the service," and managers can sue for arrears. Unauthorized fee increases or duplicate charges can be lawfully withheld.
- Cost
- Zero financial outlay. Filing an administrative complaint or telephone report takes several dozen minutes. If the management company refuses to comply and you seek tort damages for incurred losses, litigation is required.
- Benefit
- Article 944 of the Civil Code establishes three clear legal principles: (1) "The property service provider shall not coerce payment of property service fees by interrupting the supply of electricity, water, heat, gas, or other utilities"; (2) Where the property service provider has rendered services pursuant to contract, owners may not refuse payment on grounds of "not accepting or having no need to accept" services; and (3) Where an owner fails to pay on time, the provider may demand payment within a reasonable cure period; if still unpaid, the provider may institute litigation or arbitration. The Regulations on Property Management mandate that owners' committees urge delinquent owners to pay, and property enterprises may file court lawsuits upon expiration. Homeowners can file administrative complaints with real estate administrative departments of local people's governments at or above the county level, which are mandated to process complaints promptly. Furthermore, Supreme People's Court judicial interpretations confirm that if a property service company unilaterally expands billing scopes, elevates fee standards, or imposes duplicate fees in violation of contracts or laws, courts must support the owner's refusal to pay such illicit fees and must support lawsuits demanding refunds of unauthorized fees already paid.
- Note
- The law prohibits property managers from cutting off utilities as debt-collection leverage. Delinquency in paying utility companies directly for water, power, or gas is governed differently: after notice and reasonable cure periods, statutory utility providers can suspend supply according to administrative regulations with advance warning. Regulations require utility companies to bill end users directly. If unauthorized utility cutoffs inflict direct damages (e.g. frozen pipes, ruined refrigeration, spoiled goods), recover damages via court lawsuit. First-instance ordinary procedure takes at least 6 months, and summary procedure 3 months, with unrecoverable attorney fees. Landlord lockouts or utility cutoffs in rental disputes are addressed in Chapter 15, Rule 2. Benefit is categorized as Moderate.

When taking delivery of a new home, inspect the property on-site and document defects in the handover record: water leaks and utility conduit defects must be repaired by the developer within statutory warranty periods
Developers must provide a "Residential Quality Guarantee" upon handover. Statutory minimum contractor warranties require 5 years for waterproof roofs, bathrooms, and exterior walls, and 2 years for electrical wiring, plumbing, and interior finishings, running from construction acceptance. The developer's warranty to buyers cannot be shorter than the contractor's remaining warranty. If the developer delays or refuses repairs during warranty periods, you can hire third-party contractors and bill all repair costs to the developer.
- Cost
- Zero financial cost. Spend 2 to 3 hours on handover day inspecting walls, floors, doors, windows, plumbing, and electrical outlets room by room, capturing photographs of every defect. Hiring a professional third-party inspector incurs an optional inspection fee.
- Benefit
- Ministry of Housing and Urban-Rural Development regulations mandate that developers must provide buyers with a "Residential Quality Guarantee" and "Residential User Manual" upon delivering commercial housing. Developers bear statutory warranty repair liability commencing on the date of property delivery; the developer's warranty period to buyers cannot be shorter than the remaining balance of the construction contractor's warranty to the developer. For defects within warranty scope, developers must carry out repairs and compensate for consequential losses (excluding force majeure or homeowner misuse). Statutory minimum contractor warranties established by State Council regulations (calculated from final construction inspection acceptance) are: (1) 5 years for roof waterproofing, bathrooms with waterproofing requirements, rooms, and exterior wall leak prevention; (2) 2 heating/cooling seasons for heating and air-conditioning systems; (3) 2 years for electrical conduit wiring, water supply and drainage piping, equipment installation, and interior renovation finishes; and (4) the statutory design lifespan for foundations and core load-bearing structural elements. Supreme People's Court judicial interpretations establish: "If the seller refuses to repair or delays repairs within a reasonable timeframe, the buyer may execute repairs personally or commission third parties. The repair expenses and consequential damages incurred during the repair period shall be borne by the seller." If housing quality defects severely impair normal residential use, or if independent structural inspection confirms foundation or structural defects, buyers hold the statutory right to rescind the purchase contract and demand damages. Documenting defects on delivery day prevents developers from claiming that leaks were caused by your subsequent renovations.
- Note
- Specific warranty scopes and durations must be stipulated in purchase contracts; if contracts provide longer protections than statutory floors, the longer terms govern. If defects emerge, notify the developer via written registered notice and retain copies. If the developer fails to perform, file a civil claim; first-instance regular procedure takes at least 6 months with personal legal fees. Property area discrepancies are addressed in Chapter 15, Rule 12. Delays in delivery or title registration are covered in Chapter 15, Rule 13. Benefit is categorized as Moderate.
